CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 02-104 <br /> <br />RESOLUTION AUTHORIZING THE CITY MANAGER TO <br />EXECUTE QUITCLAIM DEEDS FOR PARCEL K, PARCEL <br />L AND A SMALL PORTION OF PARCEL B OF THE <br />BERNAL PROPERTY ADJACENT TO BERNAL AVENUE <br />AT INTERSTATE 680 TO BE TRANSFERRED FOR <br />CALTRANS RIGHT OF WAY PURPOSES <br /> <br />WHEREAS, <br /> <br />pursuant to the terms of the Bernal Property Preannexation Development <br />Agreement between the City of Pleasanton and GHC Bernal Investors, LLC <br />("Developers") recorded on October 27, 2000, the Developers were required to <br />transfer 318 acres of property to the City for public purposes; and <br /> <br />WHEREAS, <br /> <br />there are several small portions of the Bernal Property abutting Bernal Avenue at <br />Interstate 680 that are needed by the California Department of Transportation <br />("Caltrans") for right of way purposes and are not needed by the City for street <br />widening or any other public purpose; and <br /> <br />WHEREAS, <br /> <br />to effectuate the eventual transfer of the needed property to Caltrans, the City has <br />been requested to quitclaim any interests in Parcel K, Parcel L and a small portion <br />of Parcel B; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />The City Manager is authorized to execute the attached Quitclaim Deeds for Parcel <br />K (Attachments 1 and 2), Parcel L (Attachments 3 and 4) and a small portion of <br />Parcel B of the Bemal Property (Attachments 5 and 6), which are adjacent to <br />Bernal Avenue at Interstate 680 so that these properties can be transferred by GHC <br />Bernal Investors, LLC and Bernal Investment Company, LLC to Caltrans for right <br />of way purposes. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
