CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 02-103 <br /> <br />RESOLUTION VACATING THE PUBLIC SERVICE <br />EASEMENT ON A SMALL PORTION OF PARCEL B OF <br />THE BERNAL PROPERTY ADJACENT TO BERNAL <br />AVENUE AT INTERSTATE 680 TO BE TRANSFERRED FOR <br />CALTRANS RIGHT OF WAY PURPOSES <br /> <br />WHEREAS, <br /> <br />pursuant to the terms of the Bernal Property Preannexation Development <br />Agreement between the City of Pleasanton and GHC Bernal Investors, LLC <br />("Developers") recorded on October 27, 2000, the Developers were required to <br />transfer 318 acres of property to the City for public purposes; and <br /> <br />WHEREAS, <br /> <br />there are several small portions of the Bemal Property abutting Bernal Avenue at <br />Interstate 680 that are needed by the California Department of Transportation <br />("Caltrans") for right of way purposes and are not needed by the City for street <br />widening or any other public purpose; and <br /> <br />WHEREAS, <br /> <br />on one portion of the land required for Caltrans right of way purposes, a Public <br />Service Easement was dedicated to the City with the final subdivision map for <br />Tract 7255 recorded on August 10, 2001; and <br /> <br />WHEREAS, <br /> <br />the Public Service Easement to be vacated is located over a portion of Parcel B of <br />the Bernal Property described in the attached Exhibit A and depicted on the <br />attached Exhibit B; and <br /> <br />WHEREAS, <br /> <br />it is the intention of the City Council to summarily vacate this Public Service <br />Easement pursuant to Chapter 4 of Part 3 of Division 9 of the California Streets <br />and Highways Code as this Public Service Easement was dedicated less than five <br />years ago, but more than one year ago, and has not been used since that date for <br />locating public facilities; and <br /> <br />WHEREAS, the vacation of this Public Service Easement is consistent with the General Plan <br /> adopted by the City; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br /> <br />
