EXHIBIT D <br /> <br /> The parties agree that the City shall provide the following consideration to Roger <br />and Jane Manning: <br /> <br /> 1. Picket-style wrought iron fence six feet tall around parcel. <br /> <br /> 2. Asphalt driveway, twelve feet in width, from clubhouse road to residence. <br /> Alignment of the driveway is set forth in the attached Attachment D-1. If the <br /> Mannings desire a concrete driveway, the Mannings shall pay for the difference <br /> between the cost of asphalt and the cost of concrete. <br /> <br /> 3. Grant an easement for driveway purposes. <br /> <br /> 4. Service lines to the house, including hook-up to the house, for sanitary sewer <br /> service. <br /> <br /> 5. Remove septic tank. <br /> <br /> 6. Remove barn, with at least thirty (30) days notice. <br /> <br /> 7. Replace plumbing and electrical service for xvater well, if impacted by grading. <br /> <br /> 8. Grant of an easement from the City to the Marmings for the water well. <br /> <br /> 9. Build a cover, or other appropriate screening device, for the water well. <br /> <br /> 10. Notice to Mannings regarding timing of grading, and maintaining the <br /> Mannings' access to utilities during utility replacement. <br /> <br /> 11. Grant of easement to allow drainage from Mannings' property onto the golf <br /> course. <br /> <br /> 12. Include a condition in the Planned Unit Development Plan for the Residential <br /> Properly that will require the two homes on the north side of the Manning <br /> driveway to be limited to one story in height. <br /> <br /> 13. The City of Pleasanton Planning Department will work cooperatively with <br /> the Mannings with regard to any proposed remodel of their home. <br /> <br /> Roger and Jane Manning shall provide the following to the City: <br /> <br /> A. Execute and record a covenant in a form acceptable to the City Attorney that <br /> runs with the land indemnifying and holding the City harmless for injuries and <br /> property damage caused by golf balls and other use of the golf course. <br /> <br /> <br />
