THE PUBLIC HEARING WAS RE-OPENED. <br />Mr. Barone indicated that he agreed with the added and revised conditions and <br />suggested that if the Martinovich family comes in for an application, The Farmers <br />Restaurant be conditioned with the same one quiet night a week. He also requested <br />that the Commission consider how the noise would be monitored if both businesses that <br />share the same property line are open on the same evening. <br />Mr. MacDonald stated that he agreed with the proposed motion. <br />THE PUBLIC HEARING WAS CLOSED. <br />Chair Pearce stated that neighbor issues are one of the hardest things the Commission <br />has to work with. She noted that the Commission cannot make everyone happy and <br />hoped that the compromise arrived at makes everyone a little bit happy. She indicated <br />that if the process does not work, the matter can come back to the Commission for <br />discussion. She added that she was happy to see something to enliven the Downtown. <br />ROLL CALL VOTE: <br />AYES: Commissioners Blank, Narum, Pearce, and Pentin. <br />NOES: None. <br />ABSTAIN: None. <br />RECUSED: None. <br />ABSENT: Commissioners O’Connor and Olson. <br />Resolution No. PC-2009-26 approving PCUP-249 was entered and adopted as <br />motioned. <br />b.PRZ-41, City of Pleasanton <br />Review and consideration of amendments to Chapter 18.68 and various <br />related sections of the Pleasanton Municipal Code regarding the PUD <br />Planned Unit Development District. <br />Donna Decker presented the staff report, explaining that the amendments area a text <br />clean-up to clarify the planning process for developed properties that pre-existed as <br />PUD rezones, allow design review rather than PUD modifications, and delete the <br />definition for interim uses.The amendment would also allow Tentative Map applications <br />to be submitted and processed concurrently with PUD applications. <br />Ms. Decker noted that she received a call from a Ponderosa Homes representative, <br />stating that Submittal Requirement No. 8 under Chapter 18.68 regarding tree report <br />submittal is covered under Submittal Requirement No. 5 and requested that this be <br />struck. <br />PLANNING COMMISSION MINUTES, August 12, 2009 Page 20 of 23 <br /> <br />
