RESOLUTION NO. 09 -316 <br /> RESOLUTION DENYING CASE PAP -133, THEREBY UPHOLDING THE <br /> PLANNING COMMISSION'S DENIAL OF THE APPLICATION OF GILCHRIST <br /> RUTTER/ VINEYARD VILLA FOR A VESTING TENTATIVE MAP, AS FILED <br /> UNDER CASE PMCC -2 <br /> WHEREAS, Gilchrist RutterNineyard Villa has applied for a Vesting Tentative <br /> Map to convert a 208 -unit mobile home park located at 3263 Vineyard Avenue into <br /> residential condominium units; and <br /> WHEREAS, zoning for the property is C -F (Freeway Interchange Commercial) <br /> District; and <br /> WHEREAS, at its meeting of February 25, 2009, the Planning Commission, <br /> having considered all public testimony, relevant exhibits, and recommendations of City <br /> staff concerning this application, denied the Vesting Tentative Map; and <br /> WHEREAS, within the time specified by the Pleasanton Municipal Code, Gilchrist <br /> RutterNineyard Villa appealed the decision of the Planning Commission to the City <br /> Council; and <br /> WHEREAS, at its meetings of May 5, 2009 and August 18, 2009, the City <br /> Council received a report from the City Attorney and Director of Community <br /> Development, together with a copy of the staff report to the Planning Commission, <br /> regarding this matter; and <br /> WHEREAS, the City Council held public hearings on May 5, 2009 and <br /> August 18, 2009, at which time the applicant and any other member of the public were <br /> offered an opportunity to present evidence regarding the appeal; and <br /> WHEREAS, after a review of the materials presented, the City Council <br /> determined that the proposed Vesting Tentative Map, as conditioned, should be denied <br /> for the reasons set forth on the attached Exhibit A. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER <br /> THE FOLLOWING: <br /> SECTION 1. Denies the appeal, Case PAP -133, thereby upholding the Planning <br /> Commission's denial of Case PMCC -2, the application of Gilchrist RutterNineyard Villa <br /> for a Vesting Tentative Map to convert a 208 -unit mobile home park located at <br /> 3263 Vineyard Avenue into residential condominium units. <br /> SECTION 2. Staff is directed to send a copy of this resolution to the <br /> applicant/appellant, along with a letter, informing them that they have ninety days from the <br /> 1 <br />
