Commission or other decision making body of the <br /> City by ordinances in existence at the time a <br /> vesting tentative map is approved. For example, if <br /> the zoning district applicable to a parcel at the <br /> time rights vest under this Article designates a <br /> given use as a conditional use, then the decision <br /> making body in its reasonable discretion may <br /> approve, condition or deny the proposed conditional <br /> use on that parcel. <br /> <br /> (d) Building Codes. This Article shall not be <br /> construed to prevent changes in Uniform Fire, <br /> Building, Plumbing, Mechanical and Electrical Codes <br /> if those Code changes do not prevent use of the <br /> property for purposes permitted at the time rights <br /> vested under this Article. <br /> <br /> (e) Development Fees. This Article does not affect the <br /> establishment or collection of any development <br /> related fee. The amount of any fee imposed, <br /> including but not limited to park dedication, <br /> transportation, building permit, plan processing, <br /> inspection or any other development related fee as <br /> fixed by any ordinance or resolution of the City <br /> will be determined at the time such fee is paid. <br /> <br />§2-2.66 Term and Expiration of Development Rights. <br /> <br /> (a) Duration of Development Rights. The right to <br /> proceed with development as set forth in §2-2.64 <br /> continues for one year following the recordation of <br /> the final map or parcel map. If a project covered <br /> by a single vesting tentative map is divided into <br /> phases and more than one final map is recorded, the <br /> one year period begins for each phase when the <br /> final map for that phase is recorded. <br /> <br /> (b) Expiration of development Rights. <br /> <br /> (1) The right to proceed with development as set <br /> forth in subsection (a) shall expire if a <br /> final map is not approved before the vesting <br /> tentative map expires. <br /> <br /> (2) If the subdivider or a successor submits a <br /> complete application for a building permit <br /> during the one year period specified in <br /> subsection (a), the right to proceed with <br /> development continues until that permit or any <br /> extension of that permit granted by the City <br /> expires. <br /> <br /> <br />
