CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1232 <br /> <br /> APPROVING THE APPLICATION OF HIVEST, INC. FOR PLANNED <br /> UNIT DEVELOPMENT PLAN APPROVAL TO CONSTRUCT A TWO <br /> BUILDING, 26,190 SQ. FT. RETAIL COMMERCIAL COMPLEX ON AN <br /> APPROXIMATELY 2.0 ACRE SITE LOCATED ON THE SOUTH SIDE OF <br /> PIMLICO DRIVE APPROXIMATELY 0.1 MILE EAST OF SANTA RITA <br /> ROAD (PUD-80-15-2D) <br /> <br />WHEREAS, Hivest, Inc. applied for development plan approval for <br /> construction of a two building, 29,740 sq. ft. retail <br /> commercial complex on an approximately 2.0 acre site <br /> located on the south side of Pimlico Drive approximately <br /> 0.1 mile east of Santa Rita Road; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a negative <br /> declaration was adopted by Council on November 19, 1985; <br /> and <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendation for approval of the development plan; and <br /> <br />WHEREAS, it was determined to be appropriate and necessary to <br /> reduce the square footage of the project and to increase <br /> the setbacks; and <br /> <br />WHEREAS, a duly noticed public hearing was held on November 19, <br /> 1985; and <br /> <br />WHEREAS, the City Council finds that this development plan is <br /> consistent with the General Plan policies of the City of <br /> Pleasanton; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Approves the development plan for construction of a <br /> two building, 26,190 sq. ft. retail commercial complex <br /> on an approximately 2.0 acre site located on the south <br /> side of Pimlico Drive approximately 0.1 mile east of <br /> Santa Rita Road, subject to the conditions on Exhibit <br /> "A" attached hereto and by this reference incorporated <br /> herein, except that final plans for the design of the <br /> two buildings, landscape plan and eight ft. wall <br /> elevation shall be submitted to the Planning Commission <br /> and City Council for approval. <br /> <br />Section 2: The City staff is directed to cause a Notice of <br /> determination to be filed pursuant to Section 54.4(g) of <br /> Resolution No. 77-66. <br /> <br /> <br />
