CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 02-108 <br /> <br />RESOLUTION ESTABLISHING A RESERVE FUND FOR <br />THE PLEASANTON GOLF COURSE AND OPEN SPACE <br />PROJECT'S MITIGATION MAINTENANCE, MONITORING <br />AND POTENTIAL REPLACEMENT EXPENSES AND <br />AUTHORIZING THE CITY MANAGER TO SIGN AN <br />AGREEMENT WITH EAST BAY REGIONAL PARKS <br />DISTRICT FOR OFFSITE MITIGATION <br /> <br />WHEREAS, <br /> <br />the City has proposed financial assurances to the California Regional Water <br />Quality Control Board ("RWQCB") to guarantee success of the mitigation <br />measures for the Pleasanton Golf Course and Open Space Project; and <br /> <br />WHEREAS, <br /> <br />a reserve fund is to be established from revenues from the operations of the golf <br />course to meet known and estimated future obligations to ensure compliance with <br />the RWQCB mitigation measures; and <br /> <br />WHEREAS, <br /> <br />a reserve in the amount of $30,000 per year, beginning in the second full year of <br />operation and continuing for five years, is sufficient to address monitoring, repair <br />and restoration work which may be needed on creeks and channels, riparian <br />planting and riparian irrigation; and <br /> <br />WHEREAS, <br /> <br />the RWQCB also required the City to contribute to offsite mitigations by funding <br />land acquisition and repair and improvements on property owned by the East Bay <br />Regional Park District; and <br /> <br />WHEREAS, the City has already approved a contribution to the Regional Park District for <br /> $288,000 for this purpose. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />A reserve fund is established for the golf course beginning in the second full year <br />of operations in the amount of $30,000 per year for five years. <br /> <br /> <br />
