residence advising of the existence of an alarm <br /> policy and ordinance and outlining expected <br /> remedial action. <br /> <br /> Third false alarm in any 90 day period, a <br /> registered letter will_ be mailed to the owner or <br /> lessee with a copy of the alarm ordinance- <br /> <br /> Fourth false alarm in any 90 day period will <br /> result in a $50 charge being levied. Failure to <br /> pay will result in placement on a no-response <br /> list- <br /> <br /> Fifth false alarm will result in a $200 charge and <br /> placement on a no-response list. <br /> <br /> Any further alarms will result in no response by <br /> the Police Department. <br /> <br /> Any business or residence on a no-response list <br /> will be returned to full service upon completion <br /> of a 90 day period with no more than one false <br /> alarm response and payment of' all outstanding <br /> fees. This return to service will require payment' <br /> of a reconnection fee. <br /> <br /> (2) The intentional activation of an alarm system by <br /> any person when an emergency situation does not <br /> exist. Such emergency situations are to include <br /> only those unlawful acts for which the alarm <br /> system was specifically designed to detect or to <br /> alert the Police Department. These alarms <br /> normally will be burglary, robbery, or intrusion <br /> alarms. <br /> <br />(b) Exceptions <br /> <br /> (1) A 30 day adjustment period will be allowed to <br /> correct mecha~nical problems for any new, improved, <br /> or replacBd alarm system. <br /> <br /> 2) If the user shows that any false alarm was the <br /> result of conditions beyond his control and not <br /> the result oC negligence by himself or any of his <br /> employees, and if the result of any defect in the <br /> alarm system he neither knew nor should have <br /> known in the exercise of due care, such false <br /> al~arm shall not be deemed a "false alarm" as used <br /> in this section. <br /> <br /> <br />
