Project Phasing <br />46. Any proposed phasing of this development shall be depicted on the tentative map and shall <br /> include narrative explaining any proposed phasing. Unless a phasing plan for improvements <br /> is approved by the Planning Director, the applicant shall complete all of the on-site <br /> improvements at one time. <br /> <br />Disclosures <br />47. A statement disclosing the proximate industrial operations, including but not limited to the <br /> Pleasanton Garbage Service transfer station, gravel track haul route~ Pleasanton Police <br /> shooting range, City's Operation Service Center, and the Livermore Airport shall be <br /> prominently displayed on a minimum 24" by 36" sign in the tract sales office for this <br /> development. <br /> <br />48. <br /> <br />The recorded deed of sale for all lots covered by this PUD Development Plan approval shall <br />include the following: <br /> <br />bo <br /> <br />A clause which states that the property is in an area subject to noise, dust, and <br />vibration levels from gravel harvesting and processing and gravel truck haul route and <br />that the City of Pleasanton is not liable for possible damages due to such impacts. <br />A clause indicating the close proximity of the Livermore Municipal Airport and of <br />possible impacts to homes due to aircraft overflights. <br />A clause indicating the close proximity of the Pleasanton Garbage Service transfer <br />station, Pleasanton Police shooting range, Pleasanton Operations Center, and <br />industrial operations at the Kiewit Construction and Utility Vault facilities and <br />possible noise, dust, and related impacts from said operations and activities. <br /> <br />Wording for these clauses and/or disclosures shall be submitted to the City Attorney for <br />review and approval before City Council approval of the first final subdivision map for this <br />development and shall be recorded over the project site by separate instrument. <br /> <br />Green Building Measures <br />49. The project developer shall implement the "green building measures" listed under the <br /> "Busch/Ponderosa Project - Preliminary Green Building Checklist," dated 7-2-02, except that <br /> whole house fans shall be provided as an option. The design and construction of all of the single- <br /> family homes, including the duets, shall be covered by this approval. The project developer may <br /> modify the green building measures, e.g., add new measures, or change ex!sting measures if there <br /> are other, more effective measures, which can feasibly be done. Prior to building permit issuance, <br /> the green building provisions that are proposed to be included in the development shall be submit- <br /> ted to the Planning Director for review and comment. City staff shall arrange a meeting with the <br /> project developer to discuss the proposed measures and to determine if other feasible, mutually <br /> agreeable green building measures can be incorporated into the project. <br /> <br />City Council Page 15 of 32 August 20, 2002 <br /> <br /> <br />
