Ezidro, City Clerk <br /> <br />SUBJECT: Letter of Correction to Ordinance No. 1227, <br /> Condition of Approval No. 18 <br /> <br />DATE: July 24, 1992 <br /> <br /> A recent request for a major modification to Hopyard Village <br />Shopping Center (PUD 85-10-1M) to approve elimination of the <br />limits on high parking demand uses for the Hopyard Village <br />Center, was reviewed by City staff. As a result of this request, <br />City staff was required to review Ordinance No. 1227 and the <br />conditions of approval for PUD 85-10. After this review, staff <br />has concluded that a technical error was made in the published <br />Ordinance No. 1227, Condition 18. Currently, Condition 18 is <br />drafted as follows: <br /> <br /> "That the La Petite Academy structure may be <br /> used for child care or office uses only and <br /> the future 7000 sq. ft. structure shall be <br /> used for office use only." <br /> <br /> The minutes of the October 15, 1985 City Council meeting <br />state that the City Council intended the 7000 square foot <br />building could be used for retail uses with the exception of <br />restaurants, fast-food stores, or any use with an associated high <br />parking demand. The published Ordinance No. 1227, did not <br />incorporate the City Council's directive. <br /> <br /> Ordinance No. 1227, Condition 18 of the Conditions of <br />Approval for PUD 85-10 must be revised to incorporate the City <br />Council's direction to read as follows: <br /> <br /> "18. That the La Petite Academy structure may be <br /> used for child care or office uses only and the <br /> future 7000 sq. ft. structure shall be used for <br /> office and retail uses, except restaurants, fast- <br /> food stores, or any use with an associated high <br /> parking demand." <br /> <br /> <br />
