- 7 - <br /> <br /> 3.24 "Grantor" or "City" means the City of Pleasanton <br /> as.represented by the City Council or any delegate acting <br /> within the scope of its jurisdiction. <br /> <br /> 3.25 "Gross Annual Receipts" means the annual gross <br /> <br /> revenues received by the Grantee from all sources of operations of <br /> the Cable Communications System in the franchise area, except that <br /> any sales, excise or other taxes collected for direct pass-through to <br /> local, state or federal government shall not be included. <br /> <br /> 3.26 "Initial Service Area" means the area of the <br /> <br /> City which will receive service initially, as set forth in <br /> <br /> the franchise agreement. <br /> <br />\ 3.27 "Installation" means the connection of the <br />l!system from feeder cable to subscribers' terminals, and the <br /> Provision of service. <br /> <br /> 3.28 "Leased" or "Commercial Use Channel" means any <br /> <br />channel or portion of a channel available for lease and programming <br />by persons or entities other than the Grantee, as defined by <br />federal law. <br /> <br /> 3.29 "Local Origination Channel" means any channel <br /> <br /> where the Grantee is the Frimary designated programmer, and <br /> <br /> provides video programs to subscribers. <br /> <br /> 3.30 "Monitoring!' means observing a communication <br /> <br />signal, or the absence of a signal, where the observer is neither <br /> <br /> the subscriber, the Grantee nor the programmer, whether the signal <br /> <br />is observed by visual or electronic means, for any purpose <br />whatsoever. t'~onitoring shall not include systemwide, <br />nonindividually addressed sweeps of the system for purposes <br />of verifying system integrity, controlling return paths transmissions, <br />billing for pay-cable, or determining illegally received signals. <br /> <br /> <br />
