- 26 - <br /> <br /> (b) In the case of a foreclosure or other <br /> involuntary sale of the plant, property and equipment of the <br /> Grantee, or any part thereof, the Grantor may serve notice <br /> of termination upon the Grantee and to the purchaser at such <br /> sale, in which event the franchise and all rights and privileges <br /> of the Grantee hereunder shall cease and terminate thirty (30) <br /> days after service of such notice, unless: <br /> <br /> (1) The Grantor shall have approved the <br /> transfer of the franchise, as and in the manner in this <br /> ordinance provided; and, <br /> <br /> (2) Such successful purchaser-shall have <br /> covenanted and agreed with the Grantor to assume and be bound <br /> by all the terms and conditions of the franchise agreement. <br /> <br /> 4.17 Franchise Processing Costs. For either a new <br /> <br /> franchise award or a franchise renewal, costs to be bcrne by <br /> <br /> Grantee shall include, but shall not be limited to, all costs <br /> <br /> of publications of notices prior to any public meeting provided <br /> <br /> for pursuant to a franchise, development and publication of relevant <br /> <br />franchise ordinances and franchise agreement, fees, and any cost <br />not covered by the application fees, incurred by the Grantor <br /> <br />in its preparation of proposal solicitation documents, <br />evaluation of all applications, including, but not limited to <br />consultant and attorney fees. <br /> <br /> These franchise processing costs are over and above the <br />construction inspection and permit fees specified in Section <br />7.11(a)(1). <br /> <br /> <br />
