The Council recently adopted the three hour parking violation. Because only a few cities in Alameda County have three hour parking restrictions and the average penalty was less than both the average two hour parking violation penalty and four hour parking violation penalty, staff recommends assessing a $53 penalty which is between the proposed $50 penalty for two hour parking and the proposed $56 penalty for four hour parking. Staff also recommends adopting penalties for equipment and registration violations. Staff recommends assessing a $50 penalty for each violation to maintain consistency among all of the violations and the corresponding, county -wide average penalties. In addition, state law provides that the penalty for registration and equipment violations may be reduced upon proof of correction, and a $25 penalty is included for these fix -it tickets. For a few parking violations, staff recommends penalties that differ than the average penalties in Alameda County. For example, although the average county -wide penalty is about $50 for parking along a curb painted red, $54 for parking in front of a fire hydrant, and $230 for parking in a designated fire lane, staff recommends keeping these penalties consistent and assess a $100 penalty, which is an amount between the county -wide averages. The proposed penalties will deter parking in these areas and will retain a consistent penalty for these similar violations. Staff also proposes a $100 penalty for either parking for more than 72 hours or abandoning a vehicle. Although the average county -wide penalty for a 72 hour violation is about $61 and the average county -wide penalty for an abandoned vehicle is about $216, the $100 penalties are proposed to retain some consistency among penalties for similar violations (i.e., abandoned vehicles). Finally, the proposed penalties are $260 for parking in a bus zone or in front of the sidewalk curb that has been cut to provide wheelchair access. The $260 penalties are proposed because state law provides that the penalties may be not less than $250 and the $260 penalty is similar to the penalty assessed by other cities. Proposed Amendment to the Pleasanton Municipal Code The general penalty provisions in the Municipal Code are in Chapter 1.12 (General Penalty). Section 1.12.020 (Infractions) provides that any person who violates designated chapters of the Municipal Code is guilty of an infraction, punishable by enumerated penalties. Some of these penalties have been included in the Master Fee Schedule. For example, the penalty for a violation of Chapter 11.36 (Stopping, Standing and Parking of Vehicles) is included in the Master Fee Schedule. Although PMC Chapter 11.36 and other chapters of PMC Title 11 (Vehicles and Traffic) are listed among the violations designated as infractions in Chapter 1.12, Chapter 11.38 (Residential Parking Permit Zone) is not one of them.
