ATTACHMENT 1 ORDINANCE NO. AN ORDINANCE APPROVING AN AMENDMENT TO THE DEVELOPMENT AGREEMENT WITH KENNETH PAMELA CHRISMAN EXTENDING THE TERM OF THE DEVELOPMENT AGREEMENT BY FIVE YEARS WHEREAS, Government Code Section 65865 through 65869.5 authorizes cities and counties to enter into binding development agreements with persons having legal or equitable interests in real property for the development of such property; and WHEREAS, in 2002, the City of Pleasanton adopted Ordinance No. 1855 approving a development agreement between the City and Kenneth Pamela Chrisman "the Chrismans regarding their property located on Old Vineyard Avenue; and WHEREAS, in August 2009, the Chrismans applied to the City for an amendment to the development agreement that would extend the term of the agreement for an additional five years; and WHEREAS, after public notice, on August 12, 2009, the Planning Commission held a hearing and recommended approval of the amendment to the Development Agreement; and WHEREAS, at its meeting of September 15, 2009, the City Council reviewed the staff report from the Director of Community Development together with a copy of the staff report to the Planning Commission on this matter; and WHEREAS, on September 15, 2009, a duly- noticed public hearing was held by the City Council, at which time the applicant and members of the public were offered an opportunity to present evidence regarding the amendment to the development agreement; and WHEREAS, minor changes to land use regulations such as this are categorically exempt from CEQA; and WHEREAS, the City Council finds that the amendment to the Development Agreement is consistent with the City's General Plan. NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Approves the First Amendment to the Development Agreement, a draft copy of which is attached hereto and incorporated herein by reference, the final form of which is to be approved by the City Attorney.
