e THE CITY OF 7 <br /> j'L£ ASANTONa CITY COUNCIL AGENDA REPORT <br /> September 15, 2009 <br /> Community Development <br /> Planning Division <br /> TITLE: PDAM -02, KENNETH AND PAMELA CHRISMAN, AND JIM HAPP <br /> CONSIDER AN APPLICATION TO EXTEND THE TERM OF THE <br /> DEVELOPMENT AGREEMENT BETWEEN THE CITY OF <br /> PLEASANTON AND KENNETH AND PAMELA CHRISMAN FOR FIVE <br /> YEARS (FROM 2012 TO 2017) <br /> SUMMARY <br /> The applicants request that the Development Agreements for the development of ten <br /> (10) residential lots known as Silver Oaks Estate Phase II (formerly referred as PUD- <br /> 05/Apperson Ridge project by Centex Homes) be extended for five years, from <br /> September 23, 2012 to September 23, 2017. No other amendments to the originally <br /> approved Development Agreement are requested. <br /> PLANNING COMMISSION RECOMMENDATION <br /> Planning Commission unanimously recommended approval of the proposed <br /> amendment to the Development Agreement. <br /> RECOMMENDATION <br /> Staff recommends that the City Council adopt an ordinance approving the first <br /> amendment to the original Development Agreement between the city of Pleasanton and <br /> Kenneth and Pamela Chrisman to extend the term of the Agreement for five years. <br /> FINANCIAL STATEMENT <br /> There is no financial impact to the City. In fact, included in the first amendment, the <br /> Chrismans are required to pay for the Vineyard Avenue Corridor Specific Plan <br /> Preparation Fees which otherwise would not be required after 15 years of the adoption <br /> of the 1999 Specific Plan (effective 2014). <br />
