The sanitary sewer and water systems within the private streets serving this project will <br /> be maintained and operated by the City. The storm drain system, landscaping and <br /> irrigation system within the subdivision, and private streets will be maintained by the <br /> Homeowners Association (HOA). At the street intersections, Ponderosa Homes will be <br /> constructing pervious concrete pavement (rather then conventional asphalt) which will <br /> allow the storm water from the street to flow through the pavement and percolate into <br /> the ground. This allows the storm water to flow back into the ground, thus cleaning the <br /> water and reducing the overall storm water runoff from the site. This is possible because <br /> of the gravels that lie beneath this site. To keep the pores in the pervious concrete <br /> open, the surface of the concrete will need to be pressure washed and vacuumed <br /> annually. These design features will help filter out pollutants in the storm water in <br /> accordance with the objective of the County -wide storm water permit from the State <br /> Water Resources Control Board. As mentioned, the HOA will maintain the streets, <br /> including the pervious concrete pavement. <br /> Trail Connection <br /> An eight -foot wide unpaved trail will be constructed adjacent to the northern boundary of <br /> this development with a future phase of development. This trail will start near the Mohr <br /> Avenue /Irongate Court intersection and head east within the former Mohr Avenue right <br /> of -way to provide access to future uses in the East Pleasanton Specific Plan. <br /> Additionally, there will be a connection to the trail via the development (with a locked <br /> gate) to allow project residents direct access to the trail. <br /> Growth Management Agreement <br /> The City's Growth Management Ordinance (Chapter 17.36 of the Pleasanton Municipal <br /> Code) allows developers of larger residential projects, such as this one, to enter into a <br /> Growth Management Agreement with the City so that the City can manage residential <br /> growth. Under the Ordinance, only 350 building permits may be issued in any one year <br /> subject to certain exceptions for affordable housing projects. In recent years, the City <br /> has issued far fewer than 350 building permits annually. <br /> Ponderosa proposes to build three units this year (its models), then 20 in 2010 and in <br /> 2011, 23 in 2012 and 34 in 2013. Those numbers may be revised at Ponderosa's <br /> request subject to Council approval. <br /> Given that there has been little residential development recently in Pleasanton, <br /> Ponderosa's request can be accommodated under the Growth Management Ordinance. <br /> Discretion to Denv the Final Map <br /> The approval of a final map when the final map substantially complies with the <br /> conditions of the tentative map is a mandatory, ministerial act. (Government Code, <br /> Section 66474.1). Put another way, a final map shall be disapproved only for failure to <br /> meet conditions that were applicable at the time the tentative map was approved. If the <br /> final map is disapproved, there must be a finding identifying the conditions which were <br /> not met (Government Code, section 66473). <br /> Page 3 of 4 <br />
