RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> AUTHORIZING THE CITY MANAGER TO SERVE AS THE AUTHORIZED <br /> REPRESENTATIVE FOR PURPOSES OF REGISTERING WITH THE CENTERS OF <br /> MEDICARE AND MEDICAID SERVICES FOR MANDATORY MEDICARE <br /> REPORTING <br /> WHEREAS, with new legislation, effective July 1, 2009, all liability, no- fault, and workers' <br /> compensation insurers, self insurers, and self- insured groups, will be required to determine <br /> whether any individual claimants /applicants are entitled to Medicare benefits, and <br /> WHEREAS, the City of Pleasanton must register as the Responsible Reporting Entity <br /> (RRE) for the purpose of reporting claims, judgments, settlements, and awards for claimants <br /> who qualify for Medicare benefits, and <br /> WHEREAS, each Responsible Reporting Entity (RRE) must assign or name an <br /> Authorized Representative for the RRE between May 1, 2009, and September 30, 2009, and <br /> WHEREAS, the Authorized Representative must have legal authority to bind the <br /> organization to a contract and the terms of MMSEA Section 111 (Medicare, Medicaid, and <br /> SCRIP Extension Act of 2007) requirements and processing, and will have ultimate <br /> accountability for the Responsibility Reporting Entity's (RRE) compliance with Section 111 <br /> reporting requirements; and <br /> WHEREAS, Nelson Fialho, an employee of the City of Pleasanton, has authority to bind <br /> the City of Pleasanton to contractual terms and can be given authority to perform other duties as <br /> needed on behalf of the Pleasanton City Council. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> Section 1: This Resolution will serve as the City Council's appointment of Nelson <br /> Fialho as the Authorized Representative of the City of Pleasanton. <br /> Section 2: The City Clerk shall certify to the passage of this resolution and enter it <br /> into the book of original resolutions. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on September 15, 2009. <br />
