EXHIBIT A <br /> CONDITIONS OF APPROVAL <br /> PAP -136 (PCUP -249), Joseph and Maricela Barone <br /> 475 St. John Street <br /> September 1, 2009 <br /> 1. The approved activities /operation of Barone's Restaurant at 475 St. John <br /> Street are modified and shall conform substantially to Exhibit B (dated <br /> "Received" July 28, and August 5, 2009), on file with the Planning Division, <br /> except as modified by these conditions. Minor changes to the approved <br /> activities /operation may be approved by the Director of Community <br /> Development if determined to be in substantial conformance with the <br /> approved exhibits. <br /> 2. Except as noted below, the operation of the restaurant/bar shall be limited to <br /> the following hours: Monday through Thursday, 6:00 a.m. to 12:00 midnight; <br /> Fridays and Saturdays, 6:00 a.m. to 1:00 a.m.; and Sundays, 6:00 a.m. to <br /> 11:00 p.m. The restaurant/bar may remain open until 1:00 a.m. on March <br /> 17 (St. Patrick's Day), July 3` the Wednesday before Thanksgiving Day, <br /> December 23' and New Year's Eve each year. The outdoor music and <br /> entertainment approved by this conditional use permit modification shall <br /> cease at 9:00 p.m. for the front deck and 10:00 p.m. for the rear patio area. <br /> The outdoor music and entertainment and 6:00 a.m. openings shall be <br /> limited to six days a week of the applicants' choosing. The restaurant/bar <br /> employees shall not dispose of waste or recyclables in the trash enclosure <br /> area prior to 8:00 a.m. or after 10:00 p.m. <br /> 3. If additional hours of operation or activities beyond that proposed in the <br /> applicants' written narrative (dated "Received" August 5, 2009) or as <br /> modified by these conditions are desired, prior City review and approval is <br /> required. Except as noted below, the Director of Community Development <br /> may approve the modification or refer the matter to the Planning Commission <br /> if judged to be substantial. A future request to extend the outdoor music and <br /> 6:00 a.m. openings to seven days a week shall be subject to Planning <br /> Commission review at a public hearing. <br /> 4. The applicants shall install a noise wall west of the stage in compliance with <br /> specifications recommended by a qualified noise professional and subject to <br /> the review and approval of the Director of Community Development. The <br /> applicants shall acquire noise level reading equipment adequate to monitor <br /> noise levels related to outdoor live music at the restaurant. The applicants <br /> shall monitor noise levels at the subject site property lines each evening live <br /> outdoor music occurs to prevent noise levels from exceeding levels allowed <br /> by the noise ordinance. <br /> 5. Employees that serve alcohol shall undergo a training program, such as <br /> TIPS (Training for Intervention Procedures), designed to prevent intoxication, <br /> underage drinking, and drunk driving. <br /> 1 <br />
