EXHIBIT A CONDITIONS OF APPROVAL PAP -136 (PCUP -249), Joseph and Maricela Barone 475 St. John Street September 1, 2009 1. The approved activities /operation of Barone's Restaurant at 475 St. John Street are modified and shall conform substantially to Exhibit B (dated "Received" July 28, and August 5, 2009), on file with the Planning Division, except as modified by these conditions. Minor changes to the approved activities /operation may be approved by the Director of Community Development if determined to be in substantial conformance with the approved exhibits. 2. Except as noted below, the operation of the restaurant/bar shall be limited to the following hours: Monday through Thursday, 6:00 a.m. to 12:00 midnight; Fridays and Saturdays, 6:00 a.m. to 1:00 a.m.; and Sundays, 6:00 a.m. to 11:00 p.m. The restaurant/bar may remain open until 1:00 a.m. on March 17 (St. Patrick's Day), July 3` the Wednesday before Thanksgiving Day, December 23' and New Year's Eve each year. The outdoor music and entertainment approved by this conditional use permit modification shall cease at 9:00 p.m. for the front deck and 10:00 p.m. for the rear patio area. The outdoor music and entertainment and 6:00 a.m. openings shall be limited to six days a week of the applicants' choosing. The restaurant/bar employees shall not dispose of waste or recyclables in the trash enclosure area prior to 8:00 a.m. or after 10:00 p.m. 3. If additional hours of operation or activities beyond that proposed in the applicants' written narrative (dated "Received" August 5, 2009) or as modified by these conditions are desired, prior City review and approval is required. Except as noted below, the Director of Community Development may approve the modification or refer the matter to the Planning Commission if judged to be substantial. A future request to extend the outdoor music and 6:00 a.m. openings to seven days a week shall be subject to Planning Commission review at a public hearing. 4. The applicants shall install a noise wall west of the stage in compliance with specifications recommended by a qualified noise professional and subject to the review and approval of the Director of Community Development. The applicants shall acquire noise level reading equipment adequate to monitor noise levels related to outdoor live music at the restaurant. The applicants shall monitor noise levels at the subject site property lines each evening live outdoor music occurs to prevent noise levels from exceeding levels allowed by the noise ordinance. 5. Employees that serve alcohol shall undergo a training program, such as TIPS (Training for Intervention Procedures), designed to prevent intoxication, underage drinking, and drunk driving. 1
