a. Affordable Housing Exemption: This amendment provides a TVTC Fee <br /> exemption for all very low, low, and moderate income affordable housing units <br /> meeting the agency's affordable housing guidelines. For Pleasanton, the <br /> guidelines are set forth in Sections 17.40.020 (Lower Income Housing Fees) and <br /> 17.44 (Inclusionary Zoning) of the Pleasanton Municipal Code (PMC) which <br /> define affordable housing developments. As indicated, previously, the TVTC <br /> established guidelines based on state standards for housing developments <br /> having a minimum affordability term of 55 years (for multi family) and 45 (for <br /> single family) based on the percentage of affordable housing units to the total <br /> number of units in the project. However, due to inconsistencies with existing <br /> affordability guidelines in various member agencies, the amendment has been <br /> changed to indicate that the fee exemption may apply to affordable units that are <br /> "defined by state or local laws or regulations, with affordability terms as <br /> determined by each Party (agency) in its sole discretion." (See Section 2 of <br /> Exhibit A to Attachment 1.) <br /> b. Correction of the "Other" Fee Category: Provides a correction to how this fee <br /> category is calculated in the TVTD Fee schedule, to be consistent with its original <br /> intent to be equivalently reflective of the true cost per trip. This correction in the <br /> fee category will go into effect upon approval of the resolution. <br /> c. Administration: Amend the administrative fee language to provide a mechanism <br /> to fund administrative services, allowing for the one -half of the one percent of the <br /> TVTDF collected to be used towards the provision of administrative staffing <br /> services. The other one -half of the one percent would continue to be used for <br /> the provision of Treasurer Services. <br /> d. Fee Deferral: Incorporate a reference to the new state legislation that allows <br /> local jurisdictions to defer the collection of fees until Building Occupancy. <br /> JEPA Amendment Process <br /> An amendment to the TVTC JEPA requires unanimous approval of all seven member <br /> jurisdictions, and any amendments that require adjustment to the TVTDF involves a <br /> three -step process: <br /> Step 1 Local Approval: In this first step, all member jurisdictions were asked to <br /> support the proposed amendment and authorize their representative to endorse <br /> the proposal at an upcoming TVTC meeting. <br /> Step 2 TVTC Approval: The TVTC took formal action to approve the proposed <br /> amendment at a noticed public hearing. <br /> Page 3 of 4 <br />
