THE CITY OF 5 <br /> pL£ASANTON® CITY COUNCIL AGENDA REPORT <br /> September 1, 2009 <br /> Community Development <br /> Planning Division <br /> TITLE: PRZ -43, CONSIDER AMENDMENTS TO CHAPTER 18.40 (0 OFFICE <br /> DISTRICT) AND CHAPTER 18.44 (C COMMERCIAL DISTRICTS) OF <br /> THE PLEASANTON MUNICIPAL CODE REGARDING MASSAGE <br /> ESTABLISHMENTS <br /> SUMMARY <br /> In February 2008, the City Council approved a number of amendments to Chapter 6.24 <br /> (Massage) of Title 6, Specific Business Regulations, of the Pleasanton Municipal Code <br /> (PMC) to reflect State legislation related to the massage establishments. Additionally, <br /> further amendments to Chapter 6.24 to comply with SB 731 legislation related to <br /> certification of massage establishments were approved by the City Council on <br /> August 18, 2009. It has now become apparent that it is necessary to make <br /> amendments to Chapters 18.40 (0 Office District) and 18.44 (C Commercial District) of <br /> Title 18, Zoning, of the PMC to establish consistency with the amendments made to <br /> Chapter 6.24. This report does not recommend changes to existing land use <br /> designations regarding massage establishments. <br /> PLANNING COMMISSION RECOMMENDATION <br /> At its July 8, 2009 meeting, the Planning Commission voted unanimously (5 -0) to <br /> recommend that the City Council approve the amendments to Chapters 18.40 and <br /> 18.44 of the Pleasanton Municipal Code. <br /> RECOMMENDATION <br /> Staff recommends that the City Council: <br /> 1. Find that the adoption of the proposed amendments to the Pleasanton Municipal <br /> Code are statutorily exempted from the California Environmental Quality <br /> Act (CEQA); and <br /> 2. Introduce the attached ordinance amending Chapter 18.40 (0 Office District) and <br /> Chapter 18.44 (C Commercial Districts) of the Pleasanton Municipal Code as <br /> outlined in Exhibit A of Attachment 1. <br /> FINANCIAL STATEMENT <br /> No fiscal impact to the City or public services is anticipated. <br />
