THE CITY OF 4 <br /> CITY COUNCIL AGENDA REPORT <br /> PLEASANTONO <br /> September 1, 2009 <br /> Community Development <br /> Planning Division <br /> TITLE: PRZ -27, CONSIDER AMENDMENTS TO SECTION 18.84.090 OF THE <br /> PLEASANTON MUNICIPAL CODE REGARDING FENCING <br /> SUMMARY <br /> Staff is requesting the City Council approve amendments to the Pleasanton Municipal <br /> Code (PMC) to remove the noticing requirements on Administrative Design Review <br /> (ADR) applications for over height fences. The existing discretionary review process <br /> will remain in place with the exception of removing the noticing requirement since the <br /> affected neighbors who participate in the process submit written consent with the <br /> application and are the only parties receiving the notice. <br /> PLANNING COMMISSION RECOMMENDATION <br /> At its July 8, 2009 meeting, the Planning Commission voted unanimously (5 -0) to <br /> recommend that the City Council approve the amendments to Section 18.84.090 of the <br /> Pleasanton Municipal Code. <br /> RECOMMENDATION <br /> Staff recommends that the City Council: <br /> 1. Find that the adoption of the proposed amendments to the Pleasanton Municipal <br /> Code are statutorily exempted from the California Environmental Quality <br /> Act (CEQA); and <br /> 2. Introduce the attached ordinance amending Section 18.84.090 of the Pleasanton <br /> Municipal Code as outlined in Exhibit A of Attachment 1. <br /> FINANCIAL STATEMENT <br /> No fiscal impact on the City is anticipated. <br />
