ATTACHMENT 4 <br /> 5 &,ommons <br /> EXECUTIVE HOMES <br /> CORPORATE LEASING <br /> To the City of Pleasanton, Planning Department; <br /> We own and operate the 4 homes on Peters Avenue addresses 738 -762, and the duplex on the <br /> corner of Peters and St. John; 520 -A and 520 -B St. John. <br /> These are executive and corporate lease properties with exquisite interiors and continually <br /> well kept exteriors. Our clientele choose to live there for the ambiance and are dismayed by i! <br /> the prospect of loud music until late every night, drinking until 2:00 AM and the crowd of <br /> individuals that will unfortunately entice. <br /> While our company certainly understands the need to offset the situation our current <br /> economy has brought to the nation's businesses, there needs to be a compromise between the <br /> needs of one company and the needs of the surrounding community. <br /> In all the homes surrounding Barone's Restaurant, not just K Commons owned homes, <br /> families and individuals live who must sleep at night in order to be fresh in the morning to go <br /> to work and make their living. There are school aged children who should be abed early. <br /> When music is so loud as to be a disturbance to the nearby families enjoyment of life, and <br /> their actual health needs, then it is beyond acceptable. <br /> We believe that a compromise would be to only allow music on certain nights, not every <br /> night, music should be inside the Barone's building, but not on the deck nor in the back yard. <br /> Barone's actually has a large parcel and could build a hall on their land to accommodate <br /> music played at a later hour, with proper soundproofing. <br /> The residents at 520 -A St. Johns have just moved into our property. They have already <br /> experienced broken bottles by their front door, in the plants. They are extremely upset by the <br /> prospect of music to late hours and drinking until 2:00 AM. Regardless of their just moving <br /> in, they are giving us their notice that, if the change is permitted, our residence is now not a <br /> pleasant place to live, and they will be vacating! <br /> This puts a restraint of trade on our continuing to do business in Pleasanton. The Town's <br /> Council and Planning Department must realize that residential property that abuts <br /> commercial property needs to have very special conditions in order for all to live and work <br /> together amicably. <br /> We hereby petition the Pleasanton Town Council and The Pleasanton Planning Department <br /> to modify the conditional use permit provided to Barone's Restaurant; to music played until <br /> 10:00 PM Friday and Saturday nights, until/or when they build or provide a soundproof <br /> building in which to hold music events that do not disturb the neighborhood.
