PCUP -249, Joseph and Maricela Barone <br /> Application to modify the approved Conditional Use Permit (UP- 88 -25) for the operation <br /> of Barone's Restaurant located at 475 St. John Street to allow outdoor music and <br /> entertainment. Zoning for the property is CC (Central Commercial) District and <br /> Downtown Revitalization District. <br /> Action recommended: Approval. <br /> Action taken: Approved per staff, with the following modifications: <br /> 1. Add the following new conditions: <br /> Employees shall undergo a training program, such as TIPS (Training for <br /> Intervention Procedures), designed to prevent intoxication, underage <br /> drinking, and drunk driving. <br /> The applicants shall work with the Director of Community Development to <br /> provide acceptable directional signage for the Barone's parking lot. <br /> Prior to starting outdoor music /entertainment after 9:00 p.m., the applicants <br /> shall consult with an acoustic engineer to determine if noise mitigations can <br /> be implemented to reduce noise impacts to the neighbors. <br /> The outdoor music and 6:00 a.m. openings shall be limited to six days a <br /> week. <br /> 2. Add language to Condition No. 4 requiring the applicants to work with the Director <br /> of Community Development and Planning staff to select a means to monitor the <br /> noise between 9:00 p.m. and 10:00 p.m. with some sort of recording device that <br /> will create a record and notify the applicants should the noise exceed 70 decibels. <br /> Vote: 4 -0 -1. <br /> Submitted by: Approved by: <br /> T an Dolan Nelson Fialho <br /> Director of Community Development City Manager <br /> Page 5 of 5 <br />
