13 <br /> THE CITY OF <br /> CITY COUNCIL AGENDA REPORT <br /> pL£ASANTONo <br /> August 18, 2009 <br /> Community Development, Planning Division <br /> Law Department <br /> TITLE: FURTHER CONSIDERATION OF AN APPEAL OF THE PLANNING <br /> COMMISSION'S DENIAL OF AN APPLICATION TO CONVERT THE <br /> VINEYARD VILLA MOBILE HOME PARK TO RESIDENTIAL OWNERSHIP <br /> PROPERTY OWNER: The Guggenheim Company <br /> SUMMARY <br /> The owner of the Vineyard Villa Mobile Home Park on Vineyard Avenue is asking the <br /> City Council to overturn a decision of the Planning Commission that denied the <br /> application to convert the Park from one in which the residents rent all the spaces to <br /> one in which the residents may purchase their lots. The Council considered this matter <br /> on May 5, 2009 but then continued the item in order that additional information to the <br /> residents could be provided. Staff has provided that information to the residents and <br /> conducted meetings at the Park. Based on surveys sent to the residents in July 2009, <br /> the residents are opposed to the conversion. <br /> RECOMMENDATION <br /> Staff continues to recommend the City Council uphold the appeal, thereby conditionally <br /> approving the application to convert the Park to residential ownership. <br /> FINANCIAL STATEMENT <br /> If the appeal is granted, no fiscal impact to the City is anticipated. There could <br /> potentially be some increased property taxes that the City would receive once the lots <br /> begin to sell. If the appeal is denied, the owner has threatened to file suit. If that <br /> occurs, there will be costs associated with defending the action and the potential for <br /> monetary damages. <br />
