Councilmember Sullivan asked why the General Plan designation and rezoning could not be done <br /> together. Mr. Roush explained that it could, but warned that adopting the General Plan with a <br /> specifically limited mixed -use radius would not allow staff to return with a rezoning outside of that <br /> radius unless the General Plan were amended. <br /> Councilmember Sullivan suggested a General Plan amendment once the necessary amount of land <br /> to be rezoned is evident. <br /> Councilmember McGovern requested that the property be designated Business Park/Mixed -Use, <br /> and Mr. Fialho said there is no such designation at this time. <br /> Vice -Mayor Cook Kallio noted that most of the property is already developed and doubted there <br /> would be any rush to tear down new buildings just to create density. She asked why Council <br /> members would prepare for a worst -case scenario wherein it would not be able to recognize when <br /> the infrastructure is insufficient to support a project. <br /> Mr. Roush suggested the Council adopt the General Plan with Program 18.2 as written, with <br /> direction for staff to return in 3 months with the rezoning and a better concept of the area needed to <br /> satisfy existing and future RHNA numbers. The Council could rezone only that portion and then <br /> amend the General Plan to reflect that. <br /> Councilmember Sullivan supported the suggestion. <br /> Councilmember McGovern questioned why this is the only area staff feels is capable of meeting <br /> RHNA requirements. Mr. Roush explained that there a number of other areas in the city that could <br /> potentially be rezoned, but perhaps not in sufficient time to be in place when the Housing Element <br /> update commences. <br /> Councilmember Thorne questioned and confirmed that Mr. Roush felt confident his suggestion <br /> would provide adequate protection. <br /> Mayor Hosterman asked the Council for support to make reported changes to Program 8.1 and <br /> leave the language of Program 18.2 as is. <br /> Councilmember Sullivan said he could offer support if a commitment to do as Mr. Roush proposed <br /> was added to the language. <br /> Vice -Mayor Cook Kallio supported Program 18.1 as reflected in the amendment as well as Program <br /> 18.2 with the intent of revision, as more information is available. <br /> Mr. Fialho said the language currently states, "...provide the land use flexibility for the Hacienda <br /> Business Park, portions of Stoneridge Mall, and other areas through mixed -use designation." He <br /> suggested adding, as with the East Pleasanton Specific Plan, "clarify intent," with that intent being <br /> to plan mixed -use within a specified radius of the Bart station as it relates to Hacienda Business <br /> Park. <br /> Vice -Mayor Cook Kallio asked if intent could be signaled to state that until that radius is known, a <br /> specific distance is not specified. <br /> Mr. Fialho suggested that rather than mileage, the intent call out characteristics such as walk ability, <br /> pedestrian orientation, and reasonable distance. <br /> City Council Minutes Page 11 of 15 July 21, 2009 <br />
