CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />ORDINANCE NO. 1865 <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF <br />APPLIED BIOSYSTEMS FOR A MAJOR MODIFICATION <br />TO A PLANNED UNIT DEVELOPMENT APPROVAL, AS <br />FILED UNDER CASE PUD-98-07-2M <br /> <br />WHEREAS, <br /> <br />Applied Biosystems has applied for a major modification to an approved Planned <br />Unit Development (PUD-98-07) to modify the approved construction hours for the <br />Applied Biosystems' project located at 6001-6085 Sunol Boulevard; and <br /> <br />WHEREAS, the property is zoned PUD (Planned Unit Development) - I (Industrial) District; <br /> and <br /> <br />WHEREAS, <br /> <br />minor alterations to land use limitations are categorically exempt from the <br />requirements of the California Environmental Quality Act (CEQA), therefore, no <br />environmental document was prepared for this application; and <br /> <br />WHEREAS, the City Council received the Planning Commission's recommendations for <br /> approval of the major modification; and <br /> <br />WHEREAS, a duly noticed public hearing was held on August 6, 2002; and <br /> <br />WHEREAS, <br /> <br />the City Council finds that the proposed major modification would provide the <br />applicant with additional construction hours, while still protecting the adjacent <br />neighbors from adverse impacts. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: <br /> <br />Approves Case PUD-98-07-2M, the application of Applied Biosystems for a major <br />modification to an approved Planned Unit Development (PUD-98-07) to modify <br />the approved construction hours for the Applied Biosystems' project located at <br />6001-6085 Sunol Boulevard, subject to the conditions shown in "Exhibit B", <br />attached hereto and incorporated herein by this reference. <br /> <br />I [ [II I Ill [ Il I II [ I : <br /> <br /> <br />
