CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1349 <br /> <br /> APPROVING THE APPLICATION OF TIOGA CONSTRUCTION <br /> CORPORATION FOR PLANNED UNIT DEVELOPMENT REZONING AND <br /> DEVELOPMENT PLAN APPROVAL FOR A MIXED-USE COMMERCIAL <br /> COMPLEX TO BE LOCATED AT THE SOUTHEAST CORNER OF THE <br /> INTERSECTION OF SANTA RITA ROAD AND PIMLICO DRIVE <br /> (PUD-80-15-SD) <br /> <br />WHEREAS, Tioga Construction Corporation applied for Planned Unit <br /> Development rezoning and development plan approval for <br /> construction of an approximately 30,150 sq. ft. <br /> mixed-use commercial complex to be located at the <br /> southeast corner of the intersection of Santa Rita Road <br /> and Pimlico Drive (PUD-80-15-SD); and <br /> <br />WHEREAS, at its meeting of November 24, 1987, the Planning <br /> Commission denied the subject project; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal <br /> Code, the applicant submitted an appeal to the City <br /> Clerk of the City of Pleasanton; and <br /> <br />WHEREAS, the City council received a report from the Director of <br /> Planning and Community Development together with a copy <br /> of the staff report to the Planning Commission regarding <br /> this matter; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a negative <br /> declaration was adopted by Council on December 15, 1987; <br /> and <br /> <br />WHEREAS, a duly noticed public hearing was held on December 15, <br /> 1987; and <br /> <br />WHEREAS, the City Council finds that this development plan and <br /> rezoning is consistent with the General Plan policies of <br /> the City of Pleasanton and the purposes of the PUD <br /> ordinance; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Approves the rezoning of an approximately 3.63 acre <br /> site to the PUD-Commercial District to accommodate <br /> automobile wash, service station, food mart, restaurant <br /> and retail uses as permitted uses. <br /> <br />Section 2: The Zoning Map of the City of Pleasanton dated <br /> April 18, 1960, on file with the City Clerk, designating <br /> and dividing the City into zoning districts is hereby <br /> <br /> <br />
