CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1346 AN ORDINANCE DEFINING THE TERM "BAR" AND REQUIRING A CONDITIONAL USE PERMIT FOR ANY BAR WHEREAS, the State of California pursuant to Business and Professions Code Section 23791 has delegated to cities the authority to regulate the location and conduct of premises serving alcoholic beverages; and WHEREAS, if left uncontrolled, premises serving alcoholic beverages, can have an adverse effect on the quality of surrounding properties as a result of loitering, late evening noises, littering, defacement of buildings, drunken driving and encouragement of vice; THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Section 18.08.028 is added to the Pleasanton Municipal Code to read as follows: 18.08.028 Bar. "Bar" means any premises in which alcoholic beverages are regularly offered for sale and on-site consumption after 10:00 p.m. in the evening. A restaurant which sells alcoholic beverages after 10:00 p.m. shall be classified as a bar for purposes of this zoning code. Section 2: Table 18.44.090 of the Pleasanton Municipal Code (at page 520) is amended by repealing the clause reading "Bars, not part of restaurants and where complete meals are not served" (Seventh entry on page 520) and replacing that clause with the clause: "Bars, as defined in Section 18.08,028 PMC." Section 3: Grandfather Clause. Any restaurant which has been continuously in business during the 90 days preceding the effective date of this ordinance and which becomes a bar as a result of the redefinition of the term "bar" in this ordinance, shall not be required to obtain a conditional use permit as a bar. Section 4: This ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times," a newspaper of general circulation published in the City of Pleasanton.
