CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1346 <br /> <br /> AN ORDINANCE DEFINING THE TERM "BAR" AND REQUIRING A <br /> CONDITIONAL USE PERMIT FOR ANY BAR <br /> <br />WHEREAS, the State of California pursuant to Business and <br /> Professions Code Section 23791 has delegated to cities <br /> the authority to regulate the location and conduct of <br /> premises serving alcoholic beverages; and <br /> <br />WHEREAS, if left uncontrolled, premises serving alcoholic <br /> beverages, can have an adverse effect on the quality of <br /> surrounding properties as a result of loitering, late <br /> evening noises, littering, defacement of buildings, <br /> drunken driving and encouragement of vice; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Section 18.08.028 is added to the Pleasanton <br /> Municipal Code to read as follows: <br /> <br /> 18.08.028 Bar. <br /> <br /> "Bar" means any premises in which alcoholic <br /> beverages are regularly offered for sale and on-site <br /> consumption after 10:00 p.m. in the evening. A <br /> restaurant which sells alcoholic beverages after 10:00 <br /> p.m. shall be classified as a bar for purposes of this <br /> zoning code. <br /> <br />Section 2: Table 18.44.090 of the Pleasanton Municipal Code (at <br /> page 520) is amended by repealing the clause reading <br /> "Bars, not part of restaurants and where complete meals <br /> are not served" (Seventh entry on page 520) and <br /> replacing that clause with the clause: "Bars, as <br /> defined in Section 18.08,028 PMC." <br /> <br />Section 3: Grandfather Clause. Any restaurant which has been <br /> continuously in business during the 90 days preceding <br /> the effective date of this ordinance and which becomes a <br /> bar as a result of the redefinition of the term "bar" in <br /> this ordinance, shall not be required to obtain a <br /> conditional use permit as a bar. <br /> <br />Section 4: This ordinance shall be published once within fifteen <br /> (15) days after its adoption in "The Valley Times," a <br /> newspaper of general circulation published in the City <br /> of Pleasanton. <br /> <br /> <br />
