ATTACHMENT 4 <br /> CONTRACT <br /> VALLEY AVENUE PEDESTRIAN AND BICYCLE PATH <br /> PROJECT NO. 077036 <br /> THIS CONTRACT is made and entered into this 21st day of July, 2009, by and between <br /> SOTO BROTHERS PAVING COMPANY, INC., "Contractor whose address is 2624 Don <br /> Pedro Road, Ceres, CA 95307, and telephone number is (209) 541 -0980, and the CITY OF <br /> PLEASANTON, a municipal corporation "City <br /> WITNESSETH: <br /> WHEREAS, the City has awarded to the Contractor a contract for VALLEY AVENUE <br /> PEDESTRIAN AND BICYCLE PATH, PROJECT NO. 077036. <br /> NOW, THEREFORE, in consideration of the mutual promises set forth herein, the parties <br /> agree as follows: <br /> 1. Work to be Performed. <br /> The work shall consists of the removal and disposal of existing fence, bollards, gates and <br /> the construction of an asphalt concrete paved pedestrian/bicycle path along the south side <br /> of Valley Avenue between Case Avenue and Sunol Boulevard. <br /> Said work is more particularly shown in the following documents which are on file with <br /> the Department of Community Development/Engineering Division of the City and are <br /> incorporated herein by this reference: <br /> A. Approved Plans and Specifications entitled the VALLEY AVENUE <br /> PEDESTRIAN AND BICYCLE PATH, PROJECT NO. 077036, and <br /> addenda thereto, if any. <br /> B. Contract Change Orders approved by the City Engineer, done in <br /> accordance with the Standard Specifications. <br /> C. The elements of the proposal submitted to the City by the Contractor, <br /> which the City has accepted. <br /> 2. Compensation. The City shall pay the Contractor for work actually performed at the unit <br /> prices set out in the Contractor's proposal to the City as set forth in Exhibit A of this <br /> agreement and incorporated herein. The quantities of work stated therein are estimates <br /> only; actual quantities will be measured for payment in accordance with the <br /> specifications. <br />
