ATTACHMENT 4 CONTRACT VALLEY AVENUE PEDESTRIAN AND BICYCLE PATH PROJECT NO. 077036 THIS CONTRACT is made and entered into this 21st day of July, 2009, by and between SOTO BROTHERS PAVING COMPANY, INC., "Contractor whose address is 2624 Don Pedro Road, Ceres, CA 95307, and telephone number is (209) 541 -0980, and the CITY OF PLEASANTON, a municipal corporation "City WITNESSETH: WHEREAS, the City has awarded to the Contractor a contract for VALLEY AVENUE PEDESTRIAN AND BICYCLE PATH, PROJECT NO. 077036. NOW, THEREFORE, in consideration of the mutual promises set forth herein, the parties agree as follows: 1. Work to be Performed. The work shall consists of the removal and disposal of existing fence, bollards, gates and the construction of an asphalt concrete paved pedestrian/bicycle path along the south side of Valley Avenue between Case Avenue and Sunol Boulevard. Said work is more particularly shown in the following documents which are on file with the Department of Community Development/Engineering Division of the City and are incorporated herein by this reference: A. Approved Plans and Specifications entitled the VALLEY AVENUE PEDESTRIAN AND BICYCLE PATH, PROJECT NO. 077036, and addenda thereto, if any. B. Contract Change Orders approved by the City Engineer, done in accordance with the Standard Specifications. C. The elements of the proposal submitted to the City by the Contractor, which the City has accepted. 2. Compensation. The City shall pay the Contractor for work actually performed at the unit prices set out in the Contractor's proposal to the City as set forth in Exhibit A of this agreement and incorporated herein. The quantities of work stated therein are estimates only; actual quantities will be measured for payment in accordance with the specifications.
