17.36.220 Effect of Approval. <br /> <br /> A. The granting of growth management approval pursuant to <br />this chapter shall not exempt nor affect the developer's <br />obligation to obtain all required zoning, environmental, <br />subdivision and other approvals as are required by statute or <br />ordinance as a prerequisite to the application for building <br />permits. <br /> <br /> B. The developer may apply for and be granted necessary <br />subdivision approvals in advance of the year for which growth <br />management approval has been given. (e.g. A project with a <br />multiyear approval could apply for a single tentative map for all <br />of its growth management approved units.) <br /> <br /> C. Building permits may be obtained six months prior to <br />January 1 of the calendar year for which growth management <br />approval is given or any time thereafter until December 31 of the <br />calendar year following the calendar year for which council <br />granted growth management approval. Thus, where the council <br />grants a growth management approval for the calendar year 1989, <br />building permits for the authorized units may be obtained between <br />July 1, 1988 and December 31, 1990 (i.e. thirty months). <br /> <br /> D. No certificate of occupancy shall be issued and no final <br />building inspection shall occur until after January 1 of the <br />calendar year for which growth management approval has been <br />granted. A certificate o~ occupancy may be issued and final <br />building inspection may occur at any time thereafter so long as <br />the building permit remains valid in accordance with Uniform <br />Building Code Standards. <br /> <br /> E. All growth management approvals, when issued, shall run <br />with the land and are not transferable except with the land, <br />subject to the provisions of this chapter relating to lapsing of <br />development approval. <br /> <br />17.36.230 Lapse of Approval. <br /> <br /> A. Growth management approval shall lapse and become null <br />and void as to any approved unit for which no building permit has <br />been obtained prior to December 31 of the calendar year following <br />the calendar year for which the growth management approval was <br />granted. <br /> <br /> B. If a building permit expires after its growth management <br />approval has expired, then the building permit cannot be renewed <br />without a new growth management approval. Once a building permit <br />is issued, its time of expiration shall be controlled by Uniform <br />Building Code Standards. <br /> <br /> C. The owner of a lot created by a final map recorded prior <br />to the expiration of growth management approval shall be entitled <br />to issuance of a building permit pursuant to the single dwelling <br />unit exemption set forth in Section 17.36.140(A). <br /> <br /> - 7 - <br /> <br /> <br />
