CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1336 <br /> <br /> AN ORDINANCE MODIFYING THE CITY'S GROWTH MANAGEMENT <br /> ORDINANCE <br /> <br />WHEREAS, on August 4, 1987 the City Council initiated substantial <br /> modifications to the growth management program after <br /> holding a public hearing and considering staff reports <br /> relating to the subject matter; and <br /> <br />WHEREAS, this ordinance has been prepared in accordance with <br /> Council's direction at that proceeding; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: The former Chapter 17.36 (Growth Management Program) <br /> as set forth in PMC Sections 17.36,010 through 17.36,100 <br /> is hereby repealed and replaced in its entirety by PMC <br /> Sections 17.36.110 through 17.36,240 as set forth in <br /> Exhibit "A" attached hereto. <br /> <br />Section 2: Resolution No. 82-66, as amended, implementing the <br /> growth management ordinance is hereby repealed. <br /> <br />Section 3: Transitional Rules. <br /> <br /> A. Long-term agreements, exemption agreements and <br /> smaller project approvals granted prior to August 4, <br /> 1987, shall continue in full force and effect subject to <br /> the terms and conditions in effect at the time of their <br /> approval. <br /> <br /> B. Projects which have been granted exemption <br /> status for low income set aside units subject to <br /> negotiating growth management approval with the Council <br /> and which have not yet entered an exemption agreement <br /> with the City shall remain eligible to apply for growth <br /> management approval in this and future years in <br /> accordance with the terms and requirements provided the <br /> original exemption approval shall remain in force. <br /> <br /> C. Projects eligible for the twelve unit <br /> exemption set forth in Section 17.36,040(A)(2) on the <br /> same date as the effective date of this ordinance or <br /> before shall remain eligible for that exemption until <br /> December 31, 1987. <br /> <br /> D. The twenty-two units now available for small <br /> project approval may be claimed and used in accordance <br /> <br /> -. 1 - <br /> <br /> <br />
