CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1331 <br /> <br /> APPROVING THE APPLICATION OF ROBERT BERKEY AND BERKEY <br /> MOTORS FOR PLANNED UNIT DEVELOPMENT REZONING AND <br /> DEVELOPMENT PLAN APPROVAL FOR AN APPROXIMATELY 40,800 <br /> SQ. FT. AUTOMOBILE SALES/SERVICE FACILITY ON 5.0 ACRES <br /> LOCATED AT 4350 ROSEWOOD DRIVE (PUD-87-7) <br /> <br />WHEREAS, Robert Berkey and Berkey Motors applied for Planned Unit <br /> Development rezoning and development 'plan approval for <br /> construction of a two building, approximately 40,800 sq. <br /> ft. automobile sales/service facility to be located on <br /> an approximately 5.0 are site, located at 4350 Rosewood <br /> Drive; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a negative <br /> declaration was adopted by Council on August 18, 1987; <br /> and <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendation for approval of the development plan and <br /> rezoning; and <br /> <br />WHEREAS, a duly noticed public hearing was held on August 18, <br /> 1987; and <br /> <br />WHEREAS, the City Council finds that this development plan and <br /> rezoning is consistent with the General Plan policies of <br /> the City of Pleasanton; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Approves the rezoning of an approximately 5.0 acre <br /> site located at 4350 Rosewood Drive from "C-C" (Central <br /> Commercial) to "PUD (Planned Unit Development) - Central <br /> Commercial" District. <br /> <br />Section 2: The Zoning Map of the City of Pleasanton dated <br /> April 18, 1960, on file with the City Clerk, designating <br /> and dividing the City into zoning districts is hereby <br /> amended by Zoning Unit Map #350, attached hereto as <br /> Exhibit "A" dated August 18, 1987, and incorporated <br /> herein by reference. <br /> <br />Section 3: Approves the development plan for a two building, <br /> approximately 40,800 sq. ft. automobile sales/service <br /> facility to be located[ on an approximately 5.0 acre site <br /> at 4350 Rosewood Drive, subject to the conditions on <br /> Exhibit "B" attached hereto and by this reference <br /> incorporated herein. <br /> <br /> <br />
