CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1331 APPROVING THE APPLICATION OF ROBERT BERKEY AND BERKEY MOTORS FOR PLANNED UNIT DEVELOPMENT REZONING AND DEVELOPMENT PLAN APPROVAL FOR AN APPROXIMATELY 40,800 SQ. FT. AUTOMOBILE SALES/SERVICE FACILITY ON 5.0 ACRES LOCATED AT 4350 ROSEWOOD DRIVE (PUD-87-7) WHEREAS, Robert Berkey and Berkey Motors applied for Planned Unit Development rezoning and development 'plan approval for construction of a two building, approximately 40,800 sq. ft. automobile sales/service facility to be located on an approximately 5.0 are site, located at 4350 Rosewood Drive; and WHEREAS, based on the Initial Environmental Study, a negative declaration was adopted by Council on August 18, 1987; and WHEREAS, Council received the Planning Commission's recommendation for approval of the development plan and rezoning; and WHEREAS, a duly noticed public hearing was held on August 18, 1987; and WHEREAS, the City Council finds that this development plan and rezoning is consistent with the General Plan policies of the City of Pleasanton; THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Approves the rezoning of an approximately 5.0 acre site located at 4350 Rosewood Drive from "C-C" (Central Commercial) to "PUD (Planned Unit Development) - Central Commercial" District. Section 2: The Zoning Map of the City of Pleasanton dated April 18, 1960, on file with the City Clerk, designating and dividing the City into zoning districts is hereby amended by Zoning Unit Map #350, attached hereto as Exhibit "A" dated August 18, 1987, and incorporated herein by reference. Section 3: Approves the development plan for a two building, approximately 40,800 sq. ft. automobile sales/service facility to be located[ on an approximately 5.0 acre site at 4350 Rosewood Drive, subject to the conditions on Exhibit "B" attached hereto and by this reference incorporated herein.
