CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 02-072 WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, RESOLUTION APPROVING THE PRELIMINARY ALIGNMENT PLAN, MITIGATED NEGATIVE DECLARATION, AND MITIGATION MONITORING PLAN FOR THE APPLICATION OF THE CITY OF PLEASANTON FOR THE BERNAL PROPERTY CREEK IMPROVEMENTS at its meeting of July 9, 2002, the City Council received the preliminary alignment plan, proposed mitigated negative declaration, and mitigation monitoring plan for the application of the City of Pleasanton for the Bemal Property Creek Improvements; and the City Council received and reviewed the Initial Study dated April 5, 2002; and a duly noticed public hearing was held at which time the public was given the opportunity to comment on the alignment plan and environmental impacts of the proposed project; and the City Council finds that the preliminary alignment is included as part of the Bernal Property's Phase I improvements; and the City Council finds that based upon the review of the Initial Study and the testimony and documentary evidence presented at the public heating that there would not be a significant impact on the environment as a result of the design of the project with specific measures included to render impacts insignificant; and when an agency approves a project and adopts mitigation measures for potentially significant impacts disclosed by the environmental document, the project proponent is required by California law (Public Resources Code Section 21081.6) to establish a monitoring program to ensure that the mitigation measures are implemented; and the Mitigation Monitoring Program is provided in the attached "Supplemental Mitigation and Monitoring Reporting Program" to address the specific topic areas discussed in the negative declaration for this project.
