CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 02-072 <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />RESOLUTION APPROVING THE PRELIMINARY <br />ALIGNMENT PLAN, MITIGATED NEGATIVE <br />DECLARATION, AND MITIGATION MONITORING PLAN <br />FOR THE APPLICATION OF THE CITY OF PLEASANTON <br />FOR THE BERNAL PROPERTY CREEK IMPROVEMENTS <br /> <br />at its meeting of July 9, 2002, the City Council received the preliminary alignment <br />plan, proposed mitigated negative declaration, and mitigation monitoring plan for <br />the application of the City of Pleasanton for the Bemal Property Creek <br />Improvements; and <br /> <br />the City Council received and reviewed the Initial Study dated April 5, 2002; and <br /> <br />a duly noticed public hearing was held at which time the public was given the <br />opportunity to comment on the alignment plan and environmental impacts of the <br />proposed project; and <br /> <br />the City Council finds that the preliminary alignment is included as part of the <br />Bernal Property's Phase I improvements; and <br /> <br />the City Council finds that based upon the review of the Initial Study and the <br />testimony and documentary evidence presented at the public heating that there <br />would not be a significant impact on the environment as a result of the design of <br />the project with specific measures included to render impacts insignificant; and <br /> <br />when an agency approves a project and adopts mitigation measures for potentially <br />significant impacts disclosed by the environmental document, the project <br />proponent is required by California law (Public Resources Code Section 21081.6) <br />to establish a monitoring program to ensure that the mitigation measures are <br />implemented; and <br /> <br />the Mitigation Monitoring Program is provided in the attached "Supplemental <br />Mitigation and Monitoring Reporting Program" to address the specific topic areas <br />discussed in the negative declaration for this project. <br /> <br /> <br />
