(2) The Additional Right-of-Way as shown in Exhibit C; <br /> <br /> (3) Land necessary for the Sewer Pump Station. as described in <br /> <br /> Exhibit E; <br /> <br /> (4) Easements for the construction, operation, and maintenance of <br /> described Mitigation Land, Storm Drains and Outfalls, and <br /> Detention Basins as described in Exhibits D. F, and G: <br /> <br /> (5) Temporary construction easements around the above-described <br /> <br /> lands, as shown on the Vineyard Avenue Realignment-Right-of- <br /> Way/Easement Exhibit, dated May 7. 2002 and incorporated herein <br /> by this reference, in the form attached as Exhibit H, to last until the <br /> improvements have been accepted by the City. Such easements <br /> shall provide that access to the Property by Property Owner and <br /> Property Owner's tenants shall be maintained during the term of <br /> the construction easement. <br /> <br />Property Owner agrees to use its best efforts to achieve the dedication of <br />the Garin/Simoni Right-of-Way. connecting street, and Storm Drain and <br />Outfall easement as described in Recital D. <br /> <br />All rights-of-way and easements shall be granted within 15 days of <br />Property Owner's receipt of request for same by the City's Director of <br />Public Works, who is hereby empowered to accept and record such grants. <br />The Director of Public Works shall request the dedications only in the <br />event that: <br /> <br />Revision #2 Draft Lonestar California.
