· 2002. adopted Ordinance No. __ <br />Development Agreement. <br /> <br />approving the <br /> <br />NOW THEREFORE, it is agreed by the Ciw and Property. Owner as follows: <br /> <br />Property Subject to the Development Aereement: Successors and Assigns. Ail of <br />the Property shall be subject to this Development Agreement. The parties intend <br />that this Development Agreement shall constitute covenants which shall run with <br />the Property, and its benefits and burdens shall bind and inure to all of the <br />succesgors in interest to the Property and to the City. <br /> <br />II. <br /> <br />Term. The term of this Development Agreement shall commence upon the date <br />of execution and shall continue in full force and effect for ten (10) years <br />thereafter. <br /> <br />III. <br /> <br /> Dedication of Right-of-Way and Easements. <br /> <br />A. Property Owner agrees to dedicate the following interests in real property <br /> as shox~ in Exhibit B: <br /> (I) Roadway right-of-way for the construction of the realigned <br /> Vineyard Avenue: <br /> <br /> (2) Roadway segments as necessaD' to connect the existing Vineyard <br /> Avenue to the realigned roadway, if any; <br /> <br />Revision # 1, Draft Data Sales of California Development Agreement Page 6 of 16 <br /> <br /> <br />
