pro rata shares of the cost of such improvements, making them eligible for <br />reimbursement. Reimbursement depends on the ultimate development of the <br />parcels within the Corridor, including the Property. <br /> <br />The Specific Plan specifies the policies associated with the dedication and;or <br />acquisition of the rights-of-way for the realigned Vineyard Avenue and school <br />loop road. It was contemplated that dedication would occur as projects develop. <br />and any acquisition would occur as necessary' to incorporate the required <br />infrastructure. That portion of the Vineyard Avenue right-of-way within the <br />Property (approximately 0.5 acre) is to be dedicated as a condition of <br />development. <br /> <br />In order to construct the roadway improvements contemplated by the City and the <br />District in a financially feasible way. the right-of-way must be dedicated at oo <br />cost at this time. with eventual payment, if contelnplated in the Specific Plan. <br />taking place as development occurs, as originally contemplated. <br /> <br />PG&E has planned a 230KV transmission line in the Vineyard Corridor and has <br />received approval from the State of California Public Utilities Commission to <br />construct this line in the new right-of-way of Vineyard Avenue, if available by <br />July 1. 2002, or, if not, within the existing right-of-way. The City. the District, <br />and property owners prefer this line to be constructed in the realigned Vineyard <br /> <br />Revision # 1, Draft Data Sales of California Development Agreement Page 4 of 16 <br /> <br /> <br />
