The City. adopted the Vineyard Avenue Corridor Specific Plan (the "Specific <br />Plan"), on June I, 1999 to guide future development within its boundaD... The <br />Specific Plan sets forth land use. infrastructure, and other policies governing <br />future development of the lands within the Corridor. a key element of which is the <br />realignment of Vineyard Avenue. <br /> <br />Prior owners and optionees of the Property processed certain development plans <br />with the City in conjunction with the neighboring parcel. These plans called for <br />creating six lots on the Property, lot line adjustments with the neighboring <br />property, construction of infrastructure to serve the lots. and dedication of right- <br />of-way for a realigned Vineyard Avenue. The City approved PUD- 01 on <br /> <br />March 20. 2001 and Vesting Tentative Map 7240 on April 25, 2001. The City <br />also approved a Growth Management Agreement with Delco Builders. the <br />then-optionee, to allow development of the houses within the project to proceed in <br />an orderly, coordinated fashion. This constitutes the initial development plan for <br />the Property (the "Project"). Subsequent approvals, both discretionary and <br />ministerial on the part of the City, remain before any development can occur. <br /> <br />The nature of the infrastructure requirements to support development in the <br />eastern sector of the Specific Plan area require up-front construction of the <br />realignment of Vineyard Avenue and construction of most of the utilities within <br />it, a level of infrastructure financing typically beyond the ability of the small <br /> <br />Revision # 1~ Draft Data Sales of California Development Agreement Page 2 of 16 <br /> <br /> <br />
