forward with construction of the improvements or (ii) all necessary grants <br />of Vineyard Avenue right-of-way are not obtained by the City. <br /> <br />IV. <br /> <br />Construction of Improvements. <br /> <br />A. In the event PG&E facilities precede construction of the roadway <br /> improvements, City shall ensure that the full roadway rough grading shall <br /> be completed in conjunction with the PG&E project. <br /> <br />B. The City shall fund construction of the roadway improvements and <br /> associated utilities shown in Exhibit C (the "Phase t Improvements"). The <br /> City shall make good faith efforts to ensure the timely construction of <br /> these improvements insofar as it is within its power to do so. The intent of <br /> the parties is to have these improvements completed by September 1. <br /> 2003. <br /> <br />C. Phase II and Phase III improvements will be constructed in accordance <br /> with the Specific Plan and conditions of approval. The funding of these <br /> improvements is described in the Finance Plan. a copy of which is <br /> attached as Exhibit D. <br /> <br />Vested Development Approvals. <br /> <br />A. The Property Owner shall be vested with the right to develop the Property <br /> in accordance with and subject to the terms and conditions of the Specific <br /> Plan and existing Project approvals.
