(3) Temporary. construction easements around the above-described <br /> <br /> lands, as shown on the Vineyard Avenue Realignment-Right-of- <br /> Way/Easement Exhibit. dated Ma3, 7, 2002 and incorporated herein <br /> by this reference, in the form attached as Exhibit B, to last until the <br /> improvements have been accepted by the City. Such easements <br /> shall provide that access to the Property by Property Owner and <br /> Property Owner's tenants shall be maintained during the term of <br /> the construction easement. <br /> <br />All rights-of-way and easements shall be granted within 15 days of <br />'Property Owner's receipt of request for same by the City's Director of <br />Public Works. who is hereby empowered to accept and record such grants. <br />The Director of Public Works shall request the dedications only in the <br />event: <br /> <br />(1) PG&E gives notice to the City that it intends to build its 230KV <br /> transmission line in the realigned Vineyard Avenue and is moving <br /> forward with construction: and <br /> <br />(2) the City has given its final authorization to constructing the <br /> <br /> realigned Vineyard Avenue and associated improvements. <br /> <br />If the Property Owner transfers the property for the right-of-way and/or <br />grant easements, the City shall, at the request of Property Owner. take <br />such steps as may be necessaD' to return said property and/or easements to <br />Property Owner in the event that (i) neither PG&E nor the City move <br /> <br />Revision # 1, Draft Data Sales of Califomia Development Agreement <br /> <br />Page 7 of 16 <br /> <br /> <br />
