If any provision(s) of this Development Agreement is (are) held <br />invalid, the remainder of this Development Agreement shall not be affected and <br />shall remain in full force and effect. <br /> <br />XIII. <br /> <br />Entire Agreement. This Development Agreement. including the Recitals and <br />Exhibits, constitute the entire understanding and agreement of the parties with <br />regard to the subject matter contained herein. <br /> <br />XIV. Warranty of Capacity to Execute. Each part3, warrants that the undersigned has <br /> the capacity and authority to sign this Development Agreement on its behalf. <br /> <br />XV. <br /> <br />Effective Date. This Development Agreement was adopted by the City Council <br /> <br />of the City pursuant to Ordinance No. which became effective thirty (30) <br /> <br />days thereafter.
