CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />ORDINANCE NO. 1859 <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />AN ORDINANCE APPROVING A DEVELOPMENT <br />AGREEMENT WITH MARDEL, L.L.C. <br /> <br />Government Code Sections 65865 through 65869.5 authorizes cities and counties <br />to enter into binding development agreements with persons having legal or <br />equitable interests in real property for the development of such property; and <br /> <br />in 1999 the Vineyard Avenue Corridor Specific Plan was adopted by the City of <br />Pleasanton, specifying the right-of-way for a relocated Vineyard Avenue and the <br />core infrastructure necessary to support development of an elementary school and <br />189 new residential units; and <br /> <br />development plans for various properties have been processed to varying degrees <br />of completeness, from submittal of PUD development plans through approval of <br />tentative maps; and <br /> <br />Mardel, L.L.C. seeks a development agreement with the City of Pleasanton to vest <br />the land use entitlements in exchange for early dedication of rights-of-way and <br />easements to allow early construction of some of the core infrastructure benefiting <br />the City of Pleasanton and the Pleasanton Unified School District and eventual <br />completion of and payment for the core infrastructure in accordance with the <br />Specific Plan; and <br /> <br />after public notice, the Planning Commission held a hearing on May 14, 2002 and <br />recommended approval of the development agreement; and <br /> <br />at its meeting of May 21, 2002, the City Council held a duly noticed public <br />hearing, at which time the applicant and members of the public were offered an <br />opportunity to testify, and reviewed the staff report (SR 02:118) regarding this <br />matter; and <br /> <br />the City Council finds that no further CEQA review was necessary given that an <br />EIR was certified for the Specific Plan and additional CEQA review was <br />completed for subsequent land use reviews; and <br /> <br />the City Council finds that this development agreement is consistent with the <br />General Plan and the Vineyard Corridor Specific Plan. <br /> <br /> <br />
