III. <br /> <br /> Dedication of Right-of-Way and Easements. <br /> <br />A. Property Owner agrees to dedicate the following interests in real property <br /> as shown in Exhibit B: <br /> (1) Roadway right-of-way for the construction of the realigned <br /> Vineyard Avenue and the southerly portion of the loop road around <br /> the school site; <br /> <br /> (2) Temporary construction easements around the above-described <br /> <br /> lands as shown on the Vineyard Avenue Realignment-Right-of- <br /> Way/Easement Exhibit, dated May 7, 2002 and incorporated herein <br /> by this reference, in the form attached as Exhibit C. to last until the <br /> improvements have been accepted by the City. <br /> <br /> All rights-of-way and easements shall be granted within 15 days of <br /> Property. Owner's receipt of request for same by the City's Director of <br /> Public Works, who is hereby empowered to accept and record such grants. <br /> The Director of Public Works shall request the dedications only in the <br /> event: <br /> <br /> (1) PG&E gives notice to the City that it intends to build its 230KV <br /> transmission line in the realigned Vineyard Avenue and is moving <br /> forward with construction: and <br /> <br /> (2) the City has given its final authorization to constructing the <br /> realigned Vineyard Avenue and associated improvements. <br /> <br />Revision #2, Draft Lin Development Agreement Page 7 of 17 <br /> <br /> <br />
