No City-imposed moratorium or other future limitation (whether relating <br />to the rate, timing, or sequencing of the development or construction of all <br />or any part of the Property, whether imposed by ordinance, initiative. <br />resolution, policy, order, or otherwise, and whether enacted by the <br />Council, an agency of the Ci~,, the electorate, or otherwise), approved. <br />issued, or granted within the City or portions of the City. shall a'pply to the <br />Property to the extent such moratorium or other limitation is in conflict <br />with this Development Agreement: provided, however, the provisions of <br />this section shall not affect City's compliance with moratoria or other <br />limitations mandated by other govermnental agencies or court-imposed <br />moratoria or other limitations. <br /> <br /> Amendment and Termination. <br /> <br />A. The City has predicated its financing of the road improvements upon <br /> securing satisfactory agreements with other Vineyard Corridor property <br /> owners for timely dedication of rights-of-way and construction <br /> management. In the event the City is unable to conclude these agreements <br /> to allow the improvements to be built, this Development Agreement shall <br /> be of no further force or effect. <br /> <br />B. This Development Agreement may only be amended, rescinded, or <br /> terminated with the mutual written consent of the parties, in accordance <br /> with Government Code Section 65864 et seq. <br /> <br />Revision #1.
