CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 02-042 <br /> <br />RESOLUTION CANVASSING THE ELECTION RETURNS <br />AND DECLARING THE RESULTS OF THE APRIL 17, 2002 <br />HAPPY VALLEY ANNEXATION SPECIAL ELECTION AND <br />TERMINATING THE ANNEXATION PROCEEDING <br />BEFORE LAFCO <br /> <br />WHEREAS, a special all-mail ballot election was call by the City Council pursuant to the <br /> Califomia Elections Code, and such election was held on April 17, 2002; and <br /> <br />WHEREAS, the canvass has been duly made for the Happy Valley annexation and the returns <br /> are as follows: <br /> <br />Total ballots cast were 171, representing approximately 80.6% of the <br />eligible voters in the annexation area. <br /> <br />b. Number of votes for "yes" and "no": <br /> <br />YES 83 <br />NO 88 <br /> <br />WHEREAS, the special annexation election consisted of approval or denial of the annexation to <br /> the City of Pleasanton <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />The annexation of the designated 811 acres in the Happy Valley area to the City of <br />Pleasanton is defeated. <br /> <br />Section2: Pursuant to Government Code Section 57179, the annexation proceeding <br /> designated Annexation No. 144, Happy Valley, before the Local Agency <br /> Formation Conunission is hereby terminated. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
