Box 520 <br />200 Old Bemal Avenue <br />Pleasantnn, CA. 94566-0802 <br /> <br />GRANT OF EASEMENT <br /> <br /> THIS GRANT OF EASEMENT is made this day of ,2002 by and between the <br />Alameda County Flood Control & Water Conservation District, Zone 7, Water Agency, a district in Alameda <br />County, in the State of California, "GRANTOR", and the City of Pleasanton, in Alameda County, in the State of <br />California, a municipal corporation, "GRANTEE". <br /> <br />RECITALS <br /> <br /> A. The GRANTOR as own, er of certain real property commonly known as the "Flood Control Channel <br />Line G-l-1' ("the Property") which is designated for use as a Flood Control Channel in the County of Alameda, <br />Pleasanton Township and in the City of Pleasanton. <br /> <br /> B. GRANTOR is willing to allow a portion of the Property to be used by compatible uses if said uses do <br />not interfere with GRANTOR'S use of the Property for flood control purposes. <br /> <br /> NOW, THEREFORE, GRANTOR hereby grants and conveys to GRANTEE, a no fee easement for the <br />construction, operation, and maintenance of a vehicle and pedestxian bridge for public access spanning across the <br />Zone 7, flood control channel Line G-1-1 from Val Vista Park to Johnson Drive. The easement provides access on, <br />over and under the property for the proper maintenance of the bridge and appurtenant structures. The GRANTEE is <br />responsible for all maintenance associated with the bridge and its foundation excluding the flood control channel, <br />which will continue to be operated and maintained by the GRANTOR. The "GRANT OF EASEMENT", is as <br />described in "Exhibit A" (meets and bounds description) and "Exhibit B" (plat map), attached hereto and <br />incorporated herein by reference. <br /> <br /> GRANTEE shall advise GRANTOR regarding GRANTEE'S construction schedule and estimated time of <br />completion and require that the construction contractor obtain an encroachment permit for the construction of the <br />proposed bridge. <br /> <br /> The provisions of this GRANT OF EASEMENT shall inure to the benefit of and bind the heirs, <br />successors and assigns of the respective parties to it. <br /> <br />In witness whereof the parties have executed this Agreement as of the date first written above. <br /> <br />CITY OF PLEASANTON - GRANTEE <br /> <br />APPROVED AS TO FORM: <br /> <br />Michael H.
