Box 520 200 Old Bernal Avenue Pleasanton, CA. 94566-0802 GRANT OF EASEMENT THIS GRANT OF EASEMENT is made this day of , 2002 by and between City of Pleasanton, in Alameda County, in the State of California, a municipal corporation, "GRANTOR~', and the Alameda County Flood Control & Water Conservation District, Zone 7, Water Agency, a district in Alameda County, in the State of California, "GRANTEE~'. RECITALS A. The GRANTOR as owner of certain real property commonly known as 'Val Vista Park" ("the Property") which is designated for use as a public park in the County of Alameda, Pleasanton Township and in the City of Pleasanton. B. GRANTOR is willing to allow a portion of the Property to be used by compatible uses if said uses do not interfere with GRANTOR'S use of the Property for public park purposes. NOW, THEREFORE, GRANTOR hereby grants and conveys to GRANTEE, a no fee easement for ingress and egress to maintain the adjacent flood control channel Line G-l-1. The easement provides vehicle access on, over the property for vehicle and pedestrian access from the future bridge and roadway at Johnson Drive across the Property's proposed parking lot to continually provide access to the adjacent Zone 7, flood control channel referred to as Line G-l-1. The "GRANT OF EASEMENT", is as described in"Exhibit A" (meets and bounds description) and "Exhibit B" (plat map), attached hereto and incorporated herein by reference. The provisions of this GRANT OF EASEMENT shall inure to the benefit of and bind the heirs, successors and assigns of the respective parties to it.
