EXHIBIT A: <br /> <br /> CONDITIONS OF APPROVAL <br /> Case PUD-88-3-2M <br /> <br /> 1. That all lots within the subdivision may be sold individually <br /> for custom home development. The final house siting plans <br /> and building elevations for each individual house and lot <br /> shall be submitted for review and approval by the Planning <br /> Director prior to the issuance of a building permit for each <br /> lot. Each house siting plan shall be designed to adhere to <br /> the site development standards of the R-1-6500 zoning <br /> district. All rear yards shall have a minimum flat rear yard <br /> 20 feet in depth, with the exception of Lot 8 (as amended by <br /> Case PUD-88-3-1M). Installation of retaining walls and minor <br /> modifications of the grading plan may be necessary in order <br /> to achieve this rear yard area, with the exception of Lots <br /> 17, 18, 19, 30, 40, and 41, where no regrading shall be <br /> permitted. <br /> <br /> 2. That Design Review Board review and approval shall be <br /> required prior to the issuance of building permits for the <br /> houses to be constructed on Lots 17, 18, 19, 30, 40 and 41. <br /> <br />3. That the developer shall provide written notice to each buyer <br /> that no occupancy of any homes within the subdivision shall <br /> be allowed until final acceptance of tract improvements by <br /> the City Council has taken place. <br /> <br /> 4. That the developer shall plant screen trees along the western <br /> property line of Lot 41 prior to occupancy of the house on <br /> that lot. The species, quantity, and location of the trees <br /> shall be submitted for approval by the Planning Director <br /> before the trees are planted. <br /> <br />5. That the slope banks along the rear of Lots 19, 30, and 40 <br /> shall be planted with bushy, low profile (e.g. Eucalyptus <br /> comDacta) trees and ground cover acceptable to the Planning <br /> Director in order to soften the effect of the project <br /> grading. A final landscape and irrigation plan shall be <br /> submitted for review and approval by the Planning-Director <br /> prior to the issuance of any building permit. <br /> <br />6. That if houses on the five "impact" lots (Lots 18, 19, 30, <br /> 40, and 41) are developed by Mr. Ken Gooch, he shall be <br /> responsible as builder for meeting the specific commitments <br /> which are contained in Exhibit B (dated February 16, 1989), <br /> in addition to the conditions of approval for Cases PUD-88-3 <br /> through PUD-88-3-2M. <br /> <br />7.
