CITY COUNCIL CITY OF PLEAS~NTON <br /> <br /> AIAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1399 <br /> <br /> AN OPaINANCE kPPROVING~{EAPPLICATION OF DR. AND <br /> MRS. WILLIAM YEE FOR REZONINGAND DEVELOPMENT PLAN <br /> APPROVALAS FILEDUNDERCASE PUD-87-19 <br /> <br />WHEREAS, Dr. and Mrs. William Yee have applied to rezone an <br /> irregulary-shaped 50.36 acre site located on the west <br /> side of Foothill Road directly across from Foothill High <br /> School from the "A" (Agricultural) to the PUD - Low <br /> Density Residential and Rural Density Residential <br /> District and to obtain approval for a development plan <br /> consisting of 23 detached, single-family parcels; and <br /> <br />WHEREAS, the Planning Commission held a public hearing on the <br /> proposed changes on February 8, 1989 and made <br /> recommendations concerning same; and <br /> <br />WHEREAS, a public hearing was held on February 21, 1989 at which <br /> time the City Council reviewed the proposed rezoning and <br /> development plan and considered all reports, documents, <br /> testimony, and recommendations; and <br /> <br />WHEREAS, an Environmental Impact Report was prepared for PUD-87- <br /> 19 and on February 21, 1989 a resolution accepting the <br /> Environmental Impact Report as complete and adequate was <br /> adopted; and <br /> <br />WHEREAS, the EIR indicates significant environmental effects <br /> would result from the project, as summarized in the <br /> Environmental Impact Findings, Exhibit "A" attached <br /> hereto and made part of this case by reference; and <br /> <br />WHEREAS, CEQA and state and local EIR guidelines adopted pursuant <br /> thereto require this City Council to make specific <br /> findings where an EIR identifies one or more significant <br /> effects which may result from approval of the project; <br /> and <br /> <br />WHEREAS, thi~ City Council find~ that potentially ~ignificant <br /> effects of the project (a) have been eliminated by the <br /> revised plan and by agreed-upon-project conditions of <br /> approval; or (b) have had all feasible mitigation <br /> measures/alternatives incorporated into the plan and <br /> that remaining significant effects are outweighed by <br /> specified benefits, all as shown in the attached Draft <br /> CEQA findings; and <br /> <br /> <br />
