CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 02-031 <br /> <br />RESOLUTION ADDING AN ITEM TO THE AGENDA <br /> <br />WHEREAS, <br /> <br />information regarding pending litigation (City of Pleasanton v. Regional Water <br />Quality Control Board and Shaft'er, et al. v. City of Pleasanton) arose after the <br />Council agenda was posted requiring Council direction; and <br /> <br />WHEREAS, <br /> <br />consideration of these matters was not set forth on the City Council agenda for <br />March 19, 2002, because the information was received after the agenda was <br />posted; and <br /> <br />WHEREAS, <br /> <br />the Brown Act permits the Council to add items to the agenda with a two-thirds <br />vote when there is a finding that the items arose after the time the agenda was <br />posted and that action is necessary before the Council's next regularly scheduled <br />meeting; and <br /> <br />WHEREAS, consideration of these matters is necessary before the next regularly scheduled <br /> Council meeting; <br /> <br />NOW, THEREFORE, THE CITY COUNC1L OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />Based on the findings set forth above, a closed session discussion of the above <br />cited pending litigation is added to the March 19, 2002 agenda <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> <br />
